Terms and Conditions
Please read these terms carefully before placing an order with TCS. They govern the sale and supply of all construction and household products we offer.
Scope of these Terms
These Terms and Conditions (“Terms”) govern all orders for products placed through the TCS website (tcs.co.uk), by telephone, or by any other means. By placing an order, you agree to be bound by these Terms, which apply to both consumer buyers and trade buyers (including contractors, quantity surveyors, and construction firms). If you do not agree with any part of these Terms, please do not use our site or place an order.
These Terms comply with UK consumer protection legislation and relevant trade contract regulations. For further guidance, you may refer to the UK Government guide to website terms and conditions.
1. Order Acceptance and Payment Terms
When you place an order, you are making an offer to purchase products. We will confirm acceptance by email at which point a binding contract is formed. We reserve the right to refuse or cancel any order for any reason, including stock unavailability or payment concerns.
Payment methods: We accept major debit cards, credit cards, and other methods displayed at checkout. Full payment is due at the time of order unless we have agreed alternative arrangements for trade account customers.
VAT: All prices shown on our website are inclusive of VAT at the current UK rate unless stated otherwise. VAT will be applied to your order based on the prevailing rate at the time of dispatch.
Invoicing: For trade buyers with approved credit accounts, invoices are payable within 30 days of the invoice date unless otherwise agreed in writing. Late payments may incur interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.
2. Sale and Product Delivery Conditions
All products are described as accurately as possible, but we do not guarantee that descriptions, images, or specifications are error-free. If you receive a product that differs materially from its description, please contact us promptly.
Delivery: We will use reasonable efforts to dispatch orders within the estimated timescales shown on the product page and at checkout. Delivery times are estimates and not guaranteed. We will not be liable for any loss caused by delayed delivery.
Risk and title: Risk of loss or damage to products passes to you upon delivery. Title (ownership) passes to you when we have received full payment for the products.
If you provide a delivery address outside the UK mainland, additional charges and longer delivery times may apply. You are responsible for ensuring the delivery address is accurate and that someone is available to accept delivery.
3. Liability and Warranty Limits
The products we sell are covered by the manufacturer’s warranty and your statutory rights under UK consumer law. For trade buyers, the terms of any manufacturer’s warranty will apply.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to these Terms or the products (whether in contract, tort, or otherwise) is limited to the price you paid for the products giving rise to the claim. We will not be liable for any indirect, consequential, or incidental damages, including loss of profit, loss of business, or loss of data.
4. Account and User Responsibilities
If you register a trade account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.
You agree to provide accurate, current, and complete information about yourself during the registration and ordering process. We may suspend or terminate your account if we believe the information you have provided is false or misleading.
Trade buyers may be subject to a credit limit, which we may change at our discretion. Any orders that would exceed your credit limit may be rejected.
5. Returns, Refunds and Cancellations
If you are a consumer buyer, you have the right to cancel your order within 14 days of receiving the products, without giving any reason, under the Consumer Contracts Regulations 2013. To exercise this right, please notify us in writing (email to our contact form) within the cancellation period.
You must return the products to us within 14 days of cancellation. You are responsible for the cost of returning the products, and they must be returned in the same condition you received them. We will refund the purchase price and standard delivery costs within 14 days of receiving the returned products or evidence of return.
For trade buyers, returns are accepted only with prior authorisation and may be subject to a restocking fee. Please contact us for details.
If you receive a defective or incorrect product, please contact us promptly and we will arrange a replacement or refund at no additional cost.
6. Dispute Resolution and Governing Law
These Terms and any contract between us are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, nothing in these Terms affects your right to rely on local mandatory consumer protection laws in your country of residence.
7. Updates to These Terms
We may update these Terms from time to time. The latest version will always be posted on this page with the date of the last update. It is your responsibility to review these Terms before placing each order. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.
